Clontarf Residents & Dublin Bay Watch submit evidence

The oral hearing on the Dublin Bay infill re-commenced on Monday 30th November, location All Hallows, Drumcondra, with Dublin Bay Task Force and the Clontarf Residents Association giving their evidence, which was strong and matched the Port’s evidence in quality and scope.

This took all morning and most of the afternoon with An Taisce concluding the day’s work. Liam O’Dwyer and Joe Nolan spoke for the Task Force, and Joe McCabe for the residents. Jackie Hunt provided the Wild Bird expert opinion, and Donal O Laoire, BL, represented both Dublin Bay Task Force and the Clontarf Residents.  

Tuesday heard Breamore Port Company and various residents, and public representatives spoke.

Dublin Port cross-examine Parks Dept., and provide new evidence on Wild Bird habitat.

Dublin Port Company surprised all in attendance by submitting new evidence ‘Winter Bird Surveys in Dublin Port and Tolka estuary, Sept to Nov. ’08’ report by Natura Environmental Consultants.

Legal representation for the Port Company took some time on Wednesday cross-examining Dublin City Parks Dept. in order to prove that the area to be infilled was not a significant site for the protected species, despite its designation as a Special Protection Area under EU Law!

The Port Company’s legal representatives have asked to cross-examine Cllr. Dermot Lacey, Chair of the Dublin Bay Task Force and Brendan Price, Irish Seal sanctuary.

Dublin Bay Task Force will cross-examine Port Company’s photographer and challenge claim that infill will not impact on visual amenity.

I made my oral submission stating that no major development should go ahead in Dublin Bay until the work of the Dublin Bay Task Force was complete.  I also asked the Inspector and his team to make a site visit to judge for themselves on visual impact on the Clontarf Road.
